Payroll Tax Win for General Practice

AMA (NSW)’s advocacy campaign for an exemption for past unpaid payroll tax liabilities on contractor GP payments resulted in a win for general practice with a legislated waiver for past unpaid liabilities up to 4 September 2024.
While not an ask of the AMA(NSW) advocacy campaign, the NSW government also legislated a payroll tax rebate for general practices who make payments to contracted general practitioners if prescribed bulk-billing thresholds are met.
The bulk-billing rebate does not replace or displace exemptions under the Payroll Tax Act 2007 which may be available to general practices.
The first question is whether a payment is made under a relevant contract, and if the answer is yes, the second question is whether the general practice can rely on an exemption under the Payroll Tax Act? If an exemption is established, payroll tax is not payable.
For those general practices making payments to contracted GPs under relevant contracts where there is no exemption available, they may be eligible to claim a rebate if bulk-billing thresholds are met from 4 September 2024 onwards.
